These Terms & Conditions apply to your use of the 3 Fat Pigs website and to purchases made through our online store.

Please read these Terms & Conditions carefully before placing an order. By using our website or placing an order, you agree to these Terms & Conditions.

References to “we”, “us”, “our” in these Terms & Conditions mean Beechwood Nurseries Limited.

References to “you” or “your” mean the person placing an order or using this website.

You can contact us through the Contact Us page on our website or by using the contact details provided on the website.

2. Our products

We sell plants, trees, hedging, shrubs, fruit trees and bushes, roses and other horticultural products through our website.

We take reasonable care to ensure that product descriptions, photographs, sizes and other information displayed on the website are accurate.

Plants are living products and their appearance can naturally vary according to the season, growing conditions, age and time of dispatch. Photographs are therefore intended as a guide and individual plants may differ in appearance from photographs shown on the website.

Where a product is described by a size, height or measurement, this is an indication of the expected size and reasonable natural variation may occur.

Bare-root and dormant plants are seasonal products. Where a product is ordered in advance, the expected dispatch period will be stated on the relevant product page or elsewhere on the website.

3. Product availability

All orders are subject to availability.

Although we make reasonable efforts to keep stock information accurate, there may occasionally be circumstances where a product becomes unavailable after an order has been placed.

If a product you have ordered becomes unavailable, we may contact you to discuss an alternative product or an appropriate refund. If we cannot fulfil the order, we will refund the amount paid for the unavailable product.

We may also need to delay dispatch where weather conditions or other circumstances make it unsuitable to dispatch living plants.

4. Prices

The price payable for a product is the price displayed on the website when you place your order, subject to obvious errors.

All prices include VAT where applicable.

We reserve the right to change prices at any time. A price change will not affect an order that we have already accepted.

Delivery charges, where applicable, will be displayed during the ordering process and/or on our delivery information page.

5. Placing an order

When you place an order through our website, you are making an offer to purchase the products in your order.

After you place your order, you should receive an acknowledgement confirming that we have received it. This acknowledgement does not necessarily mean that your order has been accepted.

A contract between you and us is formed when we accept your order and confirm that the products will be supplied.

We may decline or cancel an order where, for example:

  • the product is unavailable;
  • there has been an obvious pricing or description error;
  • we are unable to deliver to the address provided;
  • payment has not been authorised;
  • we reasonably suspect fraudulent or unauthorised activity; or
  • circumstances outside our reasonable control prevent us from fulfilling the order.

If we cancel an order after you have paid, we will refund the amount paid for the cancelled products.

6. Payment

Payment must be made using the payment methods made available during checkout.

You confirm that you are authorised to use the payment method used to place the order.

We do not normally dispatch an order until payment has been successfully authorised.

7. Delivery

Our current delivery arrangements are set out on our Postage & Delivery page.

We currently offer free postage on orders to mainland UK and Northern Ireland, subject to the terms and exclusions stated on the delivery page.

We also deliver to the Republic of Ireland, subject to the applicable delivery surcharge.

Additional charges may apply to certain islands or remote delivery locations. We do not currently deliver to the Isle of Man or the Channel Islands.

The delivery charges and delivery areas published on our website may be updated from time to time.

Our current estimated dispatch time is generally 1–2 working days, with delivery generally taking a further 2–3 working days after collection by the courier, unless a different period is stated on the relevant product page or delivery information.

These are estimates rather than guaranteed delivery dates.

Some products, particularly bare-root and dormant plants, are seasonal and will be dispatched during the appropriate planting season as stated on the product page.

8. Delivery address

You are responsible for providing a complete and accurate delivery address, including the correct postcode.

Please check your delivery details carefully before completing your order.

If an order cannot be delivered because an incorrect or incomplete address was provided, additional delivery or return charges may apply where reasonably incurred.

Where the courier requires a signature, you may provide instructions at the time of ordering for the parcel to be left in a safe place where the delivery service allows this.

If you provide authority for a parcel to be left in a particular location, you acknowledge that the parcel may be left there in accordance with your instructions.

9. Delivery delays

We will make reasonable efforts to dispatch and deliver your order within the estimated times given.

However, delivery may occasionally be delayed by circumstances outside our reasonable control, including severe weather, transport disruption, courier problems, road closures, industrial action or other events beyond our reasonable control.

If your order has not arrived within the period stated on our delivery page, please contact us with your order number so that we can investigate the delivery.

Nothing in these Terms & Conditions limits your statutory rights where goods are not delivered within the period required by law.

10. Inspection of plants on delivery

Please inspect your order as soon as reasonably possible after delivery.

Plants are living products and can sometimes show signs of stress following transportation, particularly during periods of extreme weather or seasonal change.

If an item arrives damaged, appears to be seriously defective or is not what you ordered, please contact us as soon as possible and provide photographs where appropriate.

We will investigate the issue and, where appropriate, offer a replacement, refund or other remedy in accordance with your statutory rights.

11. Plant care and establishment

Once plants have been delivered, their ongoing health and establishment depends on factors including planting, watering, soil, weather, pests, disease and general aftercare.

We provide planting and care information on the website to assist customers.

We cannot guarantee that a plant will establish or grow in a particular location because these factors are outside our control.

This does not affect your statutory rights where a product is faulty, not as described or otherwise fails to meet the requirements of the Consumer Rights Act 2015.

12. Bare-root and dormant plants

Bare-root and dormant plants are seasonal products and may appear different from potted or actively growing plants.

They may be dispatched without leaves during their dormant period and may not immediately show visible signs of growth after planting.

The expected dispatch period for bare-root products will be stated on the relevant product page.

Weather conditions can affect the start and end of the bare-root season. We may therefore adjust dispatch dates where necessary to protect the plants and ensure they are suitable for dispatch.

Customers purchasing bare-root plants should follow the planting and care instructions provided on our website.

13. Changes to orders and cancellations

If you wish to cancel an order, please contact us as soon as possible using the Contact Us facility on the website and provide your order number.

If your order has not yet been dispatched, we will make reasonable efforts to cancel it.

Once an order has been dispatched, cancellation may no longer be possible before delivery and additional delivery or return costs may arise.

Consumers may have a statutory right to cancel certain distance contracts under the Consumer Contracts Regulations 2013.

However, the statutory cancellation regime contains exceptions and qualifications, including circumstances involving goods that are liable to deteriorate or expire rapidly and goods that are made to the consumer's specifications or are clearly personalised.

Because plants are living products and some products are seasonal, the statutory cancellation position may differ depending on the particular product and circumstances.

Nothing in these Terms & Conditions is intended to remove or restrict any cancellation right that you have by law.

14. Returns

Our returns procedure is explained on our Returns page.

Where a statutory right to cancel applies, we will process cancellations and refunds in accordance with applicable law.

Where you are returning goods because you have changed your mind and a statutory cancellation right applies, you may be responsible for the direct cost of returning the goods unless we have agreed otherwise or the law requires us to bear that cost.

Returned goods should be handled with reasonable care.

For living plants, we may need to take account of their condition on return when determining the appropriate remedy where the law permits this.

Nothing in this section affects your statutory rights in relation to faulty, damaged, misdescribed or otherwise non-conforming goods.

15. Faulty, damaged or incorrect goods

If you receive a product that is faulty, damaged, materially different from its description or not the product you ordered, please contact us as soon as possible.

We will investigate the problem and provide an appropriate remedy in accordance with your statutory rights.

Depending on the circumstances and applicable law, this may include repair, replacement, price reduction or refund.

You should not return a damaged or defective product at your own expense without first contacting us where we have asked you to provide photographs or otherwise agreed a particular returns procedure.

16. Our legal obligations

We will comply with the consumer rights and other legal obligations that apply to our contracts with you.

Nothing in these Terms & Conditions is intended to exclude or restrict:

  • liability that cannot legally be excluded or restricted;
  • your statutory rights as a consumer;
  • our responsibility for supplying goods that meet the requirements imposed by applicable consumer law; or
  • any other protection that cannot lawfully be excluded.

17. Website content

We make reasonable efforts to ensure that information on our website is accurate and up to date.

However, we do not guarantee that the website will always be available, uninterrupted or free from errors.

We may update, amend, suspend or withdraw parts of the website from time to time, including product descriptions, photographs, prices, stock information and other content.

Changes to website content do not affect a contract for products that we have already accepted unless the law permits or requires otherwise.

18. Intellectual property

Unless otherwise stated, the content of this website, including text, photographs, graphics, logos, product descriptions and other material, is owned by or licensed to Beechwood Nurseries Limited or the relevant rights holder.

You may view and use the website for your personal and lawful purposes.

You must not reproduce, copy, republish, sell, distribute or commercially exploit website content without our prior written permission, except where permitted by law.

All third-party trademarks and brand names remain the property of their respective owners.

19. Acceptable use

You must not use the website:

  • for any unlawful purpose;

Nothing in these Terms & Conditions excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.

Where you purchase products for business purposes rather than as a consumer, different legal rules may apply and any agreed business-to-business terms may apply to that transaction.

23. Events outside our reasonable control

We will not be responsible for failure or delay in performing our obligations where the failure or delay results from circumstances outside our reasonable control.

Such circumstances may include severe weather, flooding, fire, epidemic or pandemic, transport disruption, road closures, industrial disputes, supply-chain disruption, power or telecommunications failure, government action or other events beyond our reasonable control.

Where such an event affects your order, we will take reasonable steps to minimise the impact and will contact you where appropriate.

24. Privacy and personal information

Our processing of personal information is explained in our Privacy Notice and Privacy Policy.

We process personal information in accordance with applicable data protection legislation.

Our Privacy Notice and Privacy Policy form part of the information provided to customers but do not replace these Terms & Conditions.

25. Changes to these Terms & Conditions

We may update these Terms & Conditions from time to time.

The version applicable to an order will be the version in force when the order is accepted, unless a change is required by law or otherwise agreed with you.

The latest version will be published on this website.

26. Complaints

If you have a complaint about an order, product or our service, please contact us through the Contact Us page and provide your order number and details of the issue.

We will investigate complaints and aim to resolve them fairly and promptly.

27. Governing law and jurisdiction

These Terms & Conditions and any contract between you and us are governed by the law of Northern Ireland.

If you are a consumer resident in another part of the United Kingdom, you will continue to benefit from any mandatory consumer protections that apply to you under the law of the part of the UK in which you are resident.

Nothing in these Terms & Conditions prevents you from relying on mandatory consumer protections or bringing proceedings in a court where you are legally entitled to do so.

28. Severability

If any provision of these Terms & Conditions is found to be unlawful, invalid or unenforceable, that provision will be treated as modified or removed to the minimum extent necessary, and the remaining provisions will continue to apply.

29. Entire agreement

These Terms & Conditions, together with the information provided on the relevant product page, checkout, delivery information, returns information and applicable policies, set out the terms applicable to your purchase.

Nothing in these Terms & Conditions limits any rights or remedies that you have under applicable law.
